Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I agree that there's a huge problem with unsolicited bulk email, and I hate it, too. But, I am EXTREMELY careful and conscientious about who I include on my e-mail lists, and I NEVER send to people who have not opted in using my sign-up form. It's very frustrating to me, already, that I often cannot receive MY OWN newsletters, but that I get tons of unsolicited e-mail from spammers. I think the proposed requirement for merchants to maintain suppression lists is wrong and won't solve the problem. PLEASE consider this matter carefully. Required use of suppression lists will cause major harm to my honest newsletters and those of many other legitimate businesses that closely follow the ETHICAL guidelines of TRUE OPT-IN LISTS, who are not spammers and who carefully make certain that we only send to those who have asked us to send to them. I'm specifically concerned about the harm you'll cause to publishers like me, who ALWAYS TRUTHFULLY Require Specific Permission from the consumer prior to adding them to our lists. We are NOT the ones who CAN-SPAM was designed to stop, but this requirement will hurt the most. This is truly unfair and misguided. Please pay attention to us. We ARE legitimate businesses following ALL POSSIBLE Ethical Guidelines, with only the BEST of intentions. Also, there's a problem of consumers being confused by the technology and making mistakes when they unsubscribe from a list. Additionally, these suppression lists might be acquired by spammers, creating even MORE SPAM rather than less. Please do NOT put this ruling into effect. Please consider and make allowances for us who are doing everything right. Please do NOT penalize us, by moving ahead. THANK YOU for Your Consideration!
