Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I appreciate your efforts to try and address the problem of unsolicited bulk email. However, I am concerned about several things. First, I think the government's regulation of this area, rather than suppressing real spam, will wind up hurting legitimate on-line businesses with customer bases who opt-in to receive e-mail from these businesses. So I feel like the current law is sufficient to weed out most of the unsolicited e-mail people receive. And it leaves it up to the recipient to opt-out of any e-mail he or she does not wish to receive. Second, I strongly disagree with the idea of a "suppression list" and any regulations that are being considered to require businesses to keep "suppression lists." There are so many problems and costs associated with this idea, and so much potential damage that could be done to consumers andbusinesses alike, that I feel I must urge you to consider this matter most carefully. A requirement for suppression lists will very likely put legitimate businesses out of business, and that's not what CAN-SPAM was designed to do. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. Again, I think the current CAN-SPAM act is sufficient legislation to curb spam without harming legitimate businesses. Thank you for considering my concerns, Ellyn Davis Tennessee, USA
