Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I am happy to see you policing the internet by introducing the Can-spam Act in some form, however I am concerned that the focus appears to be threatening the legitamate businesses online. I agree that the consumer (the receiver of any email) must be protected however the consumer must uphold some responsibility along with the merchant. A responsible merchant and a responsible consumer should not be disallowed communication based on the requirement of the use of suppression lists. I see this requirement as seriously damaging to many of the big and small legitimate publications available on the internet. They're not who CAN-SPAM was designed to put out of business, but this requirement may very likely have that effect. Suppression lists could just as easily fall into the hands of spammers, leading to more spam instead of less. I am quite alarmed at the potential problems this ruling could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these concerns.
