Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I too would like to see the end of unsolicited bulk email. However, I am worried by the proposed requirement for merchants to maintain suppression lists. This idea could well disadvantage consumers and businesses alike, and I respectfully request you to consider these aspects of this matter most carefully. Required use of suppression lists will inevitably damage many legitimate publications available on the Internet. My specific fears concern publishers who require a consumer's permission before details may be added to a list. Although not the targets of CAN-SPAM legislation, they are likely to be the main victims. It is difficult to ascertain why a consumer might unsubscribe from a list, but the assumption that they would abhor any further contact of any sort is not logical. Moreover, should these suppression lists fall into the hands of spammers, they might well result in more, not less, spam. I am concerned that the potential problems posed by this ruling have not been fully considered, and beg that you assure yourselves that no such unlooked-for results will occur from its implementation.
