Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, Your efforts to control the problem of unsolicited bulk email are a worthy effort. But the proposed requirement for merchants to maintain suppression lists has fatal flaws. The many problems and costs associated with this idea, and the damage it will inflict on consumers and businesses alike are cause to urge you to consider this matter more closely. Requiring the use of suppression lists will damage beyond repair many of the legitimate publications available on the Internet. Specifically to publishers who require permission from the consumer prior to adding them to any list. They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. Also, there is potential for seriously compromising consumers because of the problem of properly knowing their intent when they unsubscribe from a list. Plus, these suppression lists could easily fall into the hands of spammers, making the problem worse instead of better, leading to more spam instead of less. I was surprised at the potential problems this ruling could involve, and urge you as strongly as possible to reconsider its implementation because of these problems, Respectfully, Kevin Smith *REDACTED PERSONAL INFORMATION*
