Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I share your concerns over unsolicited email. I regularly recieve incredible amounts of spam. Much of which is highly indecent. I've been embarrased on more than one occasion to have my children looking over my shoulder as I check email to find unsolicited porn, sometimes with blatant pictures included. That said I am alarmed at the potential problems associated with R411008. It will likely cause greater harm to businesses and consumers alike and I urge you to reconsider this measure. Requirement of the use of suppression lists will seriously damage many of the legitimate publications available on the net. My specific concern is for harm to publishers who require permission from the consumer prior to adding them to any list. They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. Adequate anti-spam legislation is already in place. The problem is no longer lack of regulation. The problem is lack of means to enforce current legislation. Spammers operate deceitfully, cloaking their ip's and identities. The only entities that will be hindered by these new measures are legitimate businesses who desire to operate ethically.
