Re: CAN-SPAM Act Rulemaking, Project No. R411008 Dear Commissioners, I am very pleased that you are looking into ways to cut down or eliminate spam. It is very frustrating receiving emails that want to sell me viagra, or a patch to make certain body parts larger. Worse yet is to open an email and have pornography on my screen. Fortunately, I no longer have that problem. I am using a spam filter that I control. I no longer see this type of junk email. We live in a great country. A free country. Because we have a free enterprise system, the solution to the spam problems has been provided by this system. Most ISP's and email software programs provide free spam filters. I have subscribed to many electronic Newsletters. Several of them are operated by individuals and not large companies. The cost associated with your proposal would put these individuals out of business. That would be a tragedy in a free country. There are hundreds, no thousands of legitimate publications and business that would not be able to afford implementing a suppression list. The CAN-SPAM act would put them out of business. I really don't think that's what you want to do. Not in this country we call America. When I unsubscribe to an electronic publication, its because I choose to do so. Please do not take that choice from me. I don't want my name added to some list that would prevent me from receiving emails from those I choose to read and subcribe to. The writers of the CAN-SPAM act undoubtedly have good intentions. However, I strongly believe that this act would be counter productive. It would create more problems than it would solve. Please do not take away my ability to choose. Please reconsider the implementation of this act. With all due respect, I fear, the proposed legislation is like washing the baby down the drain with the bath water. This act will wash thousands of legitimate publishers and business down the drain. It will wash down the drain American consumer's rights to receive information they request because the business or individual they request information may not have the resources to implement the CAN-SPM act.
