Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, Although I do applaud your efforts toward the curbing of unsolicited bulk email, spam and porn, I must express deep concern regarding the proposed requirement for honest, legitimate merchants to maintain suppression lists. The potential damage will hurt consumers and businesses alike, while likely NOT stopping the scourge of the internet, the greedy spammers and porn peddlers. Essentially, it could simply stop all worthwhile marketing effort while the spammers continue unscathed with their illegitimate activities. Requirement of the use of suppression lists will seriously damage many of the legitimate publications available on the net. My specific concern is for harm to publishers who already do require permission from the consumer prior to adding them to any list. We are all aware that these hard working, rule-following people are not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to even more spam instead of less. With all of the potential problems this suppression list ruling could involve, I implore you in the strongest possible terms to reconsider its implementation in light of the harm to honest business people such as myself, and thousands of others that would result from the enaction of this type of mandate.
