Regardless of the intent, any Can-Spam action will be ignored by those wishing to use e-mail to send spam. Technology always allows work-arounds of systems put in place to stop the flow of unwanted e-mail. Those who send spam will only be stopped if a follow-up legal action is guaranteed - something the government is not capable of, due to bureaucracy.
