An additional aggravated violation could be an unsolicited email message that has a misleading or fraudulent subject line, for example an email that affects familiarity, for example saying "I thought you might be interested in this", and turns out to be an ad for penile enhancement. Re: "forwarding to a friend" campaigns: The person who initiates such a campaign should advise in the email that such a message should not be forwarded to those who have opted-out. If this is not done, then the person initiating the message can be held liable. Also, those who forward such emails to people they do not actually know (who are not friends) should be liable.
