A 1. & 2. Primary purpose of email: If main reason is to sell a product or service, and solicits money from the recipient, it should be considered commercial even if sender is a friend or relative who does not sell the product. However, it should be treated differently than cold solicitations if forwarded by a friend, relative or co-worker, because business relies on word-of-mouth. 3. We rely on relevant info from those we know to determine if a product or service is viable, and if possible to receive the highest quality for the lowest price. How else can we determine this except through independent consumer groups or those we trust. Some of us rely on email as we are disabled or shut-ins; we are preyed upon. 4. Network marketers and others use high tech software to disconnect our adware/spyware blockers; porn pervades my links and favorites each day no matter what I use as each day I have to enable, reconnect, re-install protections, and then delete and block the same porn sites again. It makes no sense that these operators are allowed to invade our privacy. There should be a reward to those who turn these people in, and they should be prosecuted for continuous violation. I am weary of photos of little girls in compromising positions and the titles of old men. FTC should recommend appropriate software and we should be able to bill these operators for their unsolicited perversion. It's the same 12 sites all the time!!! Find out who, why and where these outfits operate, then hit them in the pocketbook. Give them the maximum sentence. It is like a never-ending virus. How do you think I feel. I run a child welfare group and a children's mental health advocacy group. I can't go to the web without there being porn in my links and favorites, and I am not a fan of porn in any form. C. Opt-out period shold be shortened to 7 days. The price of being in business should include the integrity, competence and willingness to comply with the wishes of those who receive your unsoicired mail. Recipients are bombarded hourly with unsolicited mail tht ties up their servers. Ten days is too long to wait. For porn and objectionable material of low moral standards, the time limit should be 48 hours!!! My daughter has had to deal with porn in her Favorites folder, too!! Children have no business being exposed for 10 days to more possible assaults. Schools and libraries tht have computers primarily for children's use should receive lists to block such sites as often as possible. D. Those who send pop-up or pop under ads should be noticed that they are ultimately responsible for providing a site for their opt-out customers that can be used to screen out those on the opt-out list to whom their ad is forwarded. If not, they should ultimately be held responsible for any forwarded email that goes to someone on their opt-out list. There should be an annual fund that these companies pay into to reward recipeine whistleblowers and the recipients who receive unsolicited email after they have opted out. Commercial advertisers should not be excluded from regulation for using a different name or email address for their solicitation. Industry has shown that it cannot be trusted to be self-regulating. E. Can-Spam Project: Please require identity of registered corporation in the from line and a sender name. If violated, impose a fine. Reward that the recipient can share in. Some network marketers use their first name as if friends, or say it is a virus warning!!! F. Make National Do Not Email Registry available to all elected officials for their constituents, libraries, industry, home businesses, and to ISPs. It should be easy to register to this list. System to Reward those who supply info about CAN-Spam violations should be at 20% or more of the fine. Let porn carry the maximum penalty. CAN-Spam Act should protect children, seniors and persons disabled. Do not fall for business saying it will lose money. It is public goodwill. It weeds out predators.
