On it's face, CAN-SPAM is not all that bad but it REALLY needs to be enforced. If you pick on the big spammers, maybe the smaller ones will fall into line. Spam MUSt be stopped or at least cut down. Commercial distribution of email address but be put to an end. If the big ISPs can identify spam, why can't the US Government? Spammers are now sending spam using the recipient's address as the sending address, using "()" in the From address (so it can't be bounced back, and using very misleading From addresses. That must be stopped. Also, the subject line must, at the least, start with ADV if an advertisement is being sent. Also, spammers should NOT be allowed to start the subject line with RE: as if they are replying to a message.
