Comments:
The biggest problem with the CAN-SPAM Act and state legislation regarding spam is not the actual laws; it is the enforcement of them. Only about 3% of all spam complies with the CAN-SPAM Act, but only a very small percentage of spammers are actually being prosecuted. The CAN-SPAM Act and the National Do Not Email Registry will not slow down spam to any significant degree unless there is better enforcement.
