Federal Trade Commission/Office of the Secretary, Room 11-135 (Annex W) 500 Pennsylvania Avenue, NW Washington, DC 20580 RE: Proposed Business Opportunity Rule, R511993 I am a small, home-based business owner and have been in the business almost 3 years now. I am trying to make this my primary business and to be able to quit my 9-5 M-F regular job. I feel that the upcoming proposal would seem to be biased against most home-based businesses and simply stated unfair. As to the seven days wait, someone that wants, let alone might need a product, the wait might be totally unacceptable to them. If I were on the road recruiting, this would be even more burdensome and probably more delay. As to the requirement of providing information/identity of ten sales associates in close geographic proximity to the prospective sale associate would be in most cases impossible, both logistically and realistally, especially if I were on the road to try and find them,even locally to me. I appreciate your concerns for consumer protection, but in light of the current fears of invasion of privacy and identity theft by most people, the thought of their information being given to strangers is totally unacceptable and unwarrented. Some parts of the proposed rule that requires direct sellers to give information about prior litigation does not distinguish between winning and losing lawsuits and the outcome, I do not know how I would even get that information to begin with. This proposal would require a small, minimum investment, home-based business, to be subjected to the same rules,disclosures that apply to franchises of which this certainly is not. I know there are marketers,etc that prey on the public and need to be prosecuted and stopped. There are millions of good people doing their business in a professional and ethical manner and should not be burdened by some of the new rules being proposed.
