Federal Trade Commission/Office of the Secretary, Room H-135 (Annex W) Re: Business Opportunity Rule, R511993 600 Pennsylvania Avenue, NW Washington, DC 20580 Dear Sirs: My wife and I are writing this letter because we are concerned about the proposed Business Opportunity Rule. We believe that in its presented form, it could hinder us in continuing to develop our small business. We are distributors for a nutritional company called Xango. We believe that Xango is a company of integrity, led by an outstanding team. We also believe that Xango and, by association ourselves, will be placed in a bad light if this rule becomes law. It seems to group companies such as ourselves with those who are taking advantage of the public through the use of unscrupulous methods. We agree that measures need to be taken to ensure that the American public be protected from the unscrupulous. However, to ask small business people to do things like adhere to a 7 day waiting period and to continually maintain a list of the changing 10 nearest references is asking us to add onerous tasks to the taking care of our business honestly. If there are companies out there that are taking advantage of the public, go after those companies and, in the process identify those companies that do, indeed, run honest businesses. You don’t need new, onerous rules to hinder honest people. You need to apprehend those who are already breaking the rules. Rule breakers will always find ways to get around the rules. Don’t make it more difficult for those of us who operate legitimate businesses to do business. This is a small business that we are developing to provide us with additional retirement income to be added to our Social Security income. We may not develop a large additional income, but you know that we also cannot expect to rely on Social Security alone. America has always been the land of opportunity for the small, independent business person. Let’s not stifle that opportunity. Sincerely, Stan & Adele Mingus
