Dear Mr. Secretary, I am writing in regards to Business Opportunity Rule, R511993. The changes you are considering would affect me personally in many ways. I will give you an example of a few. I am 64 years of age and my health has had a downturn in the past few years making it impossible for me to do anything physical in regards to an occupation. I was self employed for the past 30 years and when 911 happened it completely destroyed what I had built. the direct selling field is about the only way I can make a livable income. I am a representave of Xango LLC, which I think is a very legitimate direct selling company in both jproduct and characture. I have investigated many direct selling companies and found Xango to be the one I was most interested in. I have personally used their product and it is helping me more and more every day. I have given it to other people and they have had the same results. I answered an ad on the internet and a gentleman called me and sent me some litereature to read, some web sites to go to, along with names of people I could call, which I did. I say they are first class all the way. As for me, I have had a five-way heart bypass and am very limited as to my physical abilities on any job other ahan a sit down job. I am also 64, (will be 65 in Nov.) an in trying to fing a sit down job at my age, it is impossible. Also don't tell me that there is not age discrimination. I know better. I understand that there are fradulent groups out there and they should be delt with in a serious way, hard. But this new rule would put such a hard ship on the honest people in the direct selling industry that is would be impossible for them to opperate. I would like to express my appreciation the FTC's consumer protection policies, only some fine tuning on those fraudlent companies need to be attacked hard. The seven day waiting period would not work in our business as I talk to many people while I am at other functions. Actually talked to my doctors nurse about it and she said she might be interested. The $500.00 business threshold is not a good thing as many people get into the dirrect selling business on a shoestring because they have no other means of making a living. I know of one such gilr living out of the back seat of her car got started with under $40.00 and now is one of the top producers in the direct selling business area. Litigation, well, I have never had any and what I can tell only the frasulent groups out there are the ones this will concern. Yes, ther are jpeople who will gripe about anything and sue dor no reason at all. As far as earning claims go, I have been reporting mine for amny years, being self employed and it is not a problem. In regards to the "10 nearest existing sales people", someone just strting out would not have 10 plople close to him and to give out the names and addresses of other peoples customers would be just what these fradulent groups would want. They would have a hayday with this "reference" clause in this Business Opportunity Rule, R511993. To sum it all up, it would put me out of business and destroy many people who have worked long and hard to make a linving in the direct selling business. Mr. Secretary, I hope you will not consider this Business Opportunity Rule , R-511993 to be anything but a disaster to millions of hard working Americans.
