To whom it may concern: First of all I would like to thank the FTC for drafting this proposed business rule. I am an Independent Quixtar Franchise Owner (IBO) and I am deeply in favor of this rule. The only change that I believe should be made is in regards to the disclosure of past litigation. When it comes to a prospect making a decision to pursue a 100% commisioned sales opportunity, like Quixtar, I believe that disclosing past disputes is unneccesary. There are thousands of business that are being sued every day, and the disclosure of past litigation unneccesarily casts a negative light on the opportunity. If a prospect applies for an opportunity at (for example) Edward Jones or other 100% commission sales positions, does Edward Jones need to disclose all the past and present litigation that the corporation has experienced? Absolutely not. Then why should businesses, like Quixtar, have to disclose such information? The answer is that they shouldn't. Now, I have taken the liberty to form an amendment to this rule. I believe that the prospect has the right to know what the government (ex. Better Business Bureau and the FTC) and other legitimate business agencies (ex. Dunn and Bradstreet) have to say about a corporation like Quixtar. Therefore, the sponsoring IBO would have to disclose this information to the prospect instead of information involving past litigation and disputes. This solution doesn't necessarily put a company like Quixtar in a positive light, but it doesn't put the company in a negitive light either. It allows a more proper and objective representation for the company to the prospect in his consideration of the opportunity. My hope is that you have considered this option and that you will make the changes necessary to provide a better environment for business in America. In God I trust, Charles Wagner
