Kelly Klostermeyer Arbonne  Federal Trade Commission/Office of the Secretary, Room H-135 (annex W) RE: Business Opportunity Rule, R511993 600 Pennsylvania Avenue, NW Washington, DC 20580 To: Whom It May Concern, I am writing this letter because I am extremely concerned about the proposed Business Opportunity Rule R511993. I believe, it could prevent me from continuing as an Arbonne Independent Consultant. I understand your responsibility to protect the public from deceptive practices, however, I do NOT engage in these practices and this rule will make it near impossible for me to build a business with Arbonne. I strongly and passionately feel I do NOTHING deceptive, unfair or unethical to build my business. I am completely against the seven-day waiting period. Our starter kits cost a small fee. The waiting period gives the impression that there is something negative about my business and the prospect must think long and hard before they are “Tricked” into this decision. Nothing could be further from the truth. This opportunity has been a HUGE blessing to my team members. The record keeping alone would be a nightmare. And a crucial element in my business is to help people act on their excitement and get into massive activity from day one. The waiting period would SEVERLY hurt my business that I have worked so very hard to build. People would get discouraged and walk away before they even began their business. It cast such a negative light on our industry. It is unfair to not distinguish between winning and losing lawsuits. IF the company is innocent, many will not take the time to research that in-depth and assume that the company must be at fault for simply being in court. This incorrectly implies wrongdoing. This is unfair and harmful to our image and reputation. To disclose information to find references is an identify theft concern. Sharing this information could damage the business relationship I have worked so hard to build, maintain and honor. I find it an invasion of personal privacy to disclose personal data in this manner. People will walk away from our products and business based on this requirement. I joined Arbonne in February of 2005. I worked around the clock to build an incredible, ethical business. I love our products and enjoy sharing them with others. I have built a network of consumers and consultants. Together we are helping families enjoy the products and better lives together. I am so proud of what I do! If this passes, I fear I will lose everything I have worked so hard to build and it just doesn’t seem right. I am a VERY upfront, ethical, truthful person attracting other high quality, hard working men/women into my business. We are all mindful of how we go about building our business. Please DO NOT make us ALL pay for a few “bad apples” in our industry. I truly appreciate the work of the FTC in protecting consumers, but I believe this proposed rule would HURT more people than it would help…harming the livelihood of millions of successful, hard working, honest network marketing entrepreneur spirits like myself.
