Dear Sir or Madam: I am writing this letter because I am concerned about the proposed Business Opportunity Rule R511993. I believe that in its present form, it could prevent me from continuing as an independent distributor for Xango and destroy my small business. We live in the land of opportunity; a place that encourages free enterprise. Network marketing is the quintessential industry that symbolizes the freedom to conduct business from your home with unlimited potential to earn whatever you are willing to work hard for. Our company, Xango, in particular, is run by six astute businessmen who represent integrity, honesty, and the strongest work ethic. Please visit our corporate offices in Lehi, Utah, and see what a stellar example of free enterprise this company stands for. Over 500,000 distributors will be affected adversely, when all we want is the opportunity to provide an alternative way of staying home with our families, build a strong foundation there, and make enough money to give back to our communities, both locally and abroad. In addition, our owners have set aside 7% of our net profit to support charities both here and internationally. Giving back to society is what has helped us build a strong company. We adhere to following the universal principles that this nation has been founded on. A deep and abiding faith in God, country, ourselves and free enterprise. Do not take away our rights as American citizens to pursue the American dream and help other countries to fulfill their dreams of financial freedom, leading to a better quality of life and more quality time with our families. Furthermore, we are changing the societies in third world countries, such as Mexico and the Philippines. In a day and age when immigration is such an emotional issue, we are providing economic structures that will allow migrants to stay in the country of their birth. This allows them to pursue their own dreams of taking control of the land they love and improving their infrastructures so they will not need to be dependent on other nations. We are teaching self-sufficiency in the greatest sense of the word. I have been a Xango distributor for 25 months now and I have done quite well with a strong team of people who have helped me learn the fundamentals of the business. I now rely on this income to supplement my retirement One of the most difficult sections of the proposed rule is the seven day waiting period to enroll a new Xango distributor. Xango’s sales kit only cost $35.00. People buy TV’s, cars, and other items that cost much more than that and they don’t have to wait seven days. Under this waiting period requirement, I will need to keep very detailed records when I first speak to a prospect and will then have to send in reports to my company. I am a small home business and this burden could destroy my business. I also think this seven-day waiting period is unnecessary, because Xango already has a 90% buyback policy for all products including sales kits purchased by a salesperson. Finally, the proposed rule requires the disclosure of a minimum of 10 prior purchasers nearest to the prospective purchaser. I am glad to provide references, but in this day of identity theft, I am very uncomfortable giving out the personal information of individuals (without their approval) to strangers. Women in my organization may be subject to sexual or racial harassment. Furthermore, I have seen many scams on the Internet. This rule will do nothing to stop them. They hurt my business! This rule will not stop crooks – they violate the current rule all the time. But I am a good American citizen and it will hurt me. I beseech you to take a closer look at the devastation you will cause with the ushering in of this proposal, and the destruction of the quintessential free enterprise model that has been the bedrock of the American democratic society for decades.
