Federal Trade Commission Office of the Secretary Room H-135 (Annex W) 600 Pennsylvania Avenue, NW Washington, DC 20580 RE: Business Opportunity Rule, R511993 Dear Sir or Madam: I am writing you because I am concerned about the proposed Business Opportunity Rule R511993. In its presented form, it would most likely destroy my home-based business dream for my family and me. I am currently associated with XanGo LLC., located in Lehi Utah. I am now 55 years old, married and have three sons. I have either owned my own business or been employed in the workplace since I was 20. Before I was introduced to XanGo, the company and the product, I never thought there would be a direct selling home-based business that I could actually succeed with. When I was originally introduced to XanGo it was by a dear friend who knew the financial strain my family was under and knew about some health issues that I had gone through. Out of concern for me, he suggested that I try XanGo, the product, to see if it might help me. I was amazed at how the product impacted my health so I began to share the product with others. As time has passed, I have a new-found hope to possibly achieve a greater degree of financial independence as I share the XanGo opportunity with others. I have a long-range plan to involve my three sons in the business with me. My 23 year old son just graduated from college last year and is getting married this August. He is very excited about this business oppor-tunity and wants to share it with his friends. From looking at the proposed changes, my dreams for my family and myself would be destroyed. Please don’t allow that to happen. We really need the XanGo business opportunity for our financial future. I am sure that there are some dishonest companies and people involved in direct sells, just as I’m sure there are some dishonest people involved in traditional business, law enforcement and probably even the medical field and politics. Please don’t punish the legitimate companies and the honest hard working men and women because of the few. Why not turn your focus on shutting down the few rather than doing something that could shut down the entire industry? Some of the sections in the proposed rule would make it hard or almost impossible for me to sell my products and to share XanGo’s wonderful business opportunity. Obviously, the seven-day waiting period will give the public the idea that there’s something wrong with me or with XanGo which would reflect on my personal integrity. I don’t believe the seven-day waiting period is necessary. There is no ploy or strategy to burn anyone that does business with XanGo. This policy clearly reflects the confidence we have in our product and the integrity of the company. This is just one of many practices that XanGo has in place that has proven to me the high caliber and intentions of our company. Concerning the waiting period requirement, I would need to keep very detailed records of when I first speak to someone and then would have to send in reports to my company. As a small home-based business this burden could destroy my business. Finally, the proposed rule that requires the disclosure of a minimum of 10 prior purchasers nearest to the prospective purchaser. I would always be happy to give people referrals but only from those who have given me permission to do so. I would be very uncomfortable indiscriminately giving out just any ones private information, especially single women or single moms. In conclusion, I’m not sure implementing your new rules would stop the crooks. I’m afraid that only those who really want to operate a legitimate home business will be the ones to suffer. Please don’t allow this potential ruling to destroy my dreams. Mitch Kersh
