Dear Sir or Madam, I have recently wrote to you once, regarding the proposed Business Opportunity rule. But, I have some other thoughts that I would like you to consider. After reading this website, I understand why this rule was proposed. It stems from Business Opportunities such as; envelope stuffing, medical billing, data entry which are truly a scam. I know many people have been ripped of by these fly by night companies, including myself. But, I take it as a learning experience, those types of companies will always be there no matter what. Here is what bothers me about this proposal. The Companies, such as Scent-Sations, Inc. Mary Kay, Avon, Tupperware, Pampered Chef, not to mention all of the healthcare/wellness product companies, the companies that follow the rules and the laws will be the ones that suffer. Not the fly by night companies, such as the envelope stuffers, medical billing, data entry, etc. The fly by night companies are always going to come and go, like they always have. These companies do not care about the rules or laws and will find away around any rules that are made. So who's left holding the bag? The Companies that already follow the rules and laws. Scent-Sations, Inc. the company of which I am a distributor for has the following policies. Buy back policy Follow's the cooling off rule by the FTC Charges sales tax on our purchases and distributes the sales tax to the appropriate states. Issues 1099's Corporate keeps in contact each week with all distributors. Corporate has an 800 number that distributors can call when they have questions or need help and people are there to help you. Has member forums where distributors can go for training or help. Has a members backoffice where we can log into to obtain marketing materials and training. Etc. I hope you see where I am going with this? What you are doing, is grouping all the legitimate companies with the fly by nights. It is unfair and you are punishing the ones that already do business the right way. Why can't you get the word out there alittle more about the fly by nights. Yes, you have them posted on your website, but what about the people that don't have the internet? There are hundreds of people out there that haven't a clue that these companies are rip offs. I think if you made the public alittle more aware of what to look for when shopping for a Business Opportunity, such as what I listed above that Scent-Sations, Inc. has, that would stop alot of it right there. I would be putting broadcasts out on the television stations, newspapers, etc. and I would keep broadcasting it over and over. I also think that the legitmate companies would not mind posting the rules and laws that they follow on their websites. That would be proof enough to the consumer that they are a good company to be a part of. I guess what it all boils down to is, the way the Business Opportunity Rule is written now, will hurt the legitimate Businesses and the distributors (small guy) that is just trying to make an honest buck with a good company.
