June 8, 2006 Re: Business Opportunity Rule R5141993 Dear Sir: I want to express strong opposition to this proposed rule. Protecting the public from unfair or deceptive practices is important, but this rule would make it too difficult for me to operate my business as a Shaklee Independent Distributor. The 7 day waiting period to enroll new distributors would create confusion, because most of the people who sign a Shaklee application are consumers of the products. They pay $19.95 to register with Shaklee to get the discount pricing as a distributor (distributing to themselves). If they decide to build a business later, they only need to supply Shaklee their social security number or tax ID number. No extra fee is required. Shaklee has a money back quarantee on the products & a 90% buyback policy for products purchased in the last 2 years if you were building a business and decided to quit. Shaklee uses fair practices, and we should not have our business burdened with such a proposed ruling. I would be uncomfortable giving out my prior purchasers name and information to a prospective purchaser. This would be an unfair and unsafe practice because of privacy or even identify theft. When people decide to build a business with Shaklee, they want to begin making money immediately. To have a waiting peroid because of all the restrictions you are proposing, would discourage and create skepticism since other business transactions don't require anything like this. As to providing information regarding lawsuits, that only makes sense to report if the company was found guilty. Anyone can file a lawsuit, but if the company or employees are found not quilty, there could be no reason to have to supply that information. This would be unfair to reputable companies like Shaklee who has been in business for 50 years. I have been a Shaklee Distributor for more than 25 years and depend on this extra income to supplement my budget. Small or large in home businesses make up a large segment of our economy, keeps Moms at home with their family and the government has always encourage people to take advantages of these businesses. The proposed ruling would hamper tremendously our ability to grow our business. Thank you for considering my comments. Sincerely, Marynell Perkins
