To Whom It May Concern: I am writing this letter because I am concerned about the proposed Business Opportunity Rule R511993. I believe that in its present form, it could prevent me from continuing as a ENIVA Distributor. Many of the sections in the proposed rule will make it impossible for me to sell ENIVA products. I have been selling Eniva products for over 4 years. I am a Full-Time independent Eniva Distributor and my family relies upon this income to exist. My Attached Letter below outlines my concerns and provides some suggestions in more detail. Since retail and wholesale businesses do not encounter the same restrictions for their products sales, it appears that the FTC is trying to violate it's own rules in regards to restrain-of-trade of one business type versus another? If these changes are passed and put into force resulting in my Total Loss of Income, I will have no Alternative than to join a Class Action lawsuit against the FTC, along with hundreds of thousands of my fellow networkers in the industry. Of course, this is not my desire, as it would do no one good, except perhaps the attorneys, least of all the image of the FTC, in regards to protecting Citizens and Consumer Rights, because of all the National Media Coverage it would receive. I have no doubt such action would end up in the Supreme Court of the United States with TV and newspaper coverage. I appreciate the work of the FTC to protect consumers, but I believe this proposed new rule has many unintended consequences and that there are far less burdensome alternatives available in achieving its goals. Why not talk directly with Chief Executives of the Network Marketing/Direct Sales/MLM Industry companies to get the right answers you are seeking? Thank you for your time and I hope that you will reach a good decision for everyone concerned. I have always believed that the right solution is only One Question away. Sincerely, Carl Erickson
