Dear Mr. Hartvigsen:

The Division of Enforcement staff has completed an investigation of Nu Skin’s possible
violation of the cease and desist order issued in Docket No. C-3489 and the consent decree entered in Civil Action No. 2:97CV 0626G (D. Utah 1997) in connection with its marketing of distributorships to sell various goods and services. Upon further review of this matter, it now appears that no further action is warranted by the Commission at this time. Accordingly, the investigation has been closed. This action is not to be construed as a determination that a violation has not occurred, just as the pendency of an investigation should not be construed as a determination that a violation has occurred. The Commission reserves the right to take such further action as the public interest may require.
