Civil Action No. FINAL JUDGMENT Plaintiff, Federal Trade Commission, having commenced this action by filing its Complaint herein for violations of an Order issued by the Federal Trade Commission on December 15, 1994, in FTC Docket No. C-3546, and Defendant, Rite Aid Corporation ("Rite Aid"), having consented to the entry of this Final Judgment to settle all claims raised in that Complaint without trial or adjudication of any issue of fact or of law herein and without this Final Judgment constituting any evidence against or an admission by any party with respect to any such issue: NOW, THEREFORE, prior to the taking of any testimony and without trial or adjudication of any issue of fact or of law herein, and upon the consent of the parties hereto, it is hereby ORDERED, ADJUDGED, AND DECREED as follows: I. This Court has jurisdiction of the subject matter herein and of each of the parties consenting hereto. The Complaint states a claim upon which relief may be granted against Rite Aid under Sections 5(l) and 16(a)(1) of the Federal Trade Commission Act, 15 U.S.C. §§ 45(l) and 56(a)(1). II. Judgment is hereby entered in favor of the Plaintiff, Federal Trade Commission, and against the Defendant, Rite Aid. III. Rite Aid shall pay to the United States, pursuant to Section 5(l) of the Federal Trade Commission Act, 15 U.S.C. § 45(l), a civil penalty in the amount of nine hundred thousand United States dollars ($900,000), which shall be paid and delivered in the following manner:
