The Federal Trade Commission has given final approval to a
consent agreement with Newtron Products Company, Inc., and its
principals, Michael S. Duty and Donald G. Attermeyer, settling
charges that, among other things, they deceptively advertised the
ability of their Newtron Electrostatic Air Cleaner to remove
fungal spores and pollen from the air in consumers' homes.
Newtron Products Company is located in Cinncinnati, Ohio.
Under the final consent order, the respondents are
prohibited from claiming that scientific tests conducted in the
homes of allergy sufferers establish that the Air Cleaner or any
substantially similar device can remove 94 percent of fungal
spores or 100 percent of pollen from the air in homes. In
addition, the respondents are prohibited from misrepresenting the
contents, validity, results, conclusions, or interpretations of
any test or study.
The final order also requires Newtron to have competent and
reliable evidence to substantiate any future claims about the
performance characteristics of any air cleaning product.
The agreement was placed on the public record on Sept. 13,
1991 and issued in final form on March 16. (Docket No. C-3375)
The Commission vote to approve the consent agreement was 4-
0, with Commissioner Dennis A. Yao not participating.
NOTE: A consent agreement is for settlement purposes only and
does not constitute admission of a law violation. When the
Commission issues a consent order on a final basis, it carries
the force of law with respect to future actions. Each violation
of such an order may result in a civil penalty of up to $10,000.
