    FTC Issues Final Rule Implementing Fairness to Contact Lens Consumers Act
    The Federal Trade Commission has issued its final rule implementing the Fairness to Contact Lens Consumers Act. The Act, which was enacted on December 6, 2003, requires that contact lens prescribers provide patients with a copy of their contact lens prescriptions after a contact lens fitting and verify those prescriptions to any third party designated by a patient, such as an online seller.

    In comments provided today at the request of Michigan House Representative Gene DeRossett on Michigan House Bill 4757, commonly referred to as the “Petroleum Marketing Stabilization Act,” staff of the Federal Trade Commission stated that, if enacted, the bill likely would restrict competition and lead to higher prices for the state’s consumers.

    The Federal Trade Commission is seeking public comment to aid staff in preparing a study examining “the effects of requiring that a consumer who has experienced an adverse action based on a credit report receive a copy of the same credit report that the creditor relied on in taking the adverse action.; The Commission will hold a roundtable discussion on June 30, 2004, to aid the FTC staff in conducting a study of the accuracy and completeness of consumer reports, as required by the Fair and Accurate Credit Transactions Act (FACTA).

    New Mexico Physicians' Group Agrees to Settle FTC Price-Fixing Charges
    A Roswell, New Mexico-based physicians' association and two of its employees have agreed to settle Federal Trade Commission charges that they orchestrated agreements among Southeastern New Mexico Physicians IPA (SENM) members to fix prices and to refuse to deal with payors except on collectively agreed-upon terms, and thereby increased the price of health care in the area. The proposed consent order bars the association and its employees from engaging in similar action in the future.
