If anything qualifies as a not-to-be-missed event in the antitrust world, it is happening next Mon., June 23. That’s the day that the FTC and the Department of Justice will hold a joint public workshop on conditional pricing practices. Take a look at the agenda and you’ll see that we have assembled a world-class group of attorneys and academics who have studied, analyzed, and written about distribution strategies, including conditional pricing practices such as loyalty discounts and bundled pricing.
Conditional pricing is a dynamic and evolving area of antitrust, and we anticipate lively debate about controversial topics such as the value of the price-cost test, and the extent to which standards articulated in judicial decisions align—or fail to align—with the relevant theories of competitive harm and benefit. The day will start at 8:30 a.m. with introductions by DoJ’s Assistant Attorney General Bill Baer and FTC Commissioner Maureen Ohlhausen. From there, it promises to be a day full of interesting panel discussions and roundtables—essential to observers who work in the field or have interest in the topic.
The workshop is free and open to the public and will take place at the FTC’s new conference center located at Constitution Center, 400 Seventh Street SW.
