Contractual barriers that prevent me from excercising my basic rights the constitution gives me. If my franchisor uses unfair and deceptive acts or practices, they should, like any other business owner, be held accountable in a court of law for them. As a franchisee I should not have to sign anything that makes me give up by legal rights and claims. As a franchisee I should be able to discuss problems with the franchisor with existing franchisees or even potential ones. No one should force me to sign a gag order to prevent my freedom of speech here. As a franchisee I should be able to resolve disputes in the state where I do business. Not in the franchisors home state. My business partner and I have been in a franchise for 25 years. We recently had to decide whether or not to renew our contract with our franchisor. We had a very successful business but the new contract was scary. We did sign because we had no choice other than to change or name.
