    The Commission has authorized the filing of a joint amicus brief with the Department of Justice in McMahon v. Advanced Title Services Company of West Virginia, a case before the West Virginia Supreme Court of Appeals.The Commission has advised Bristol-Myers Squibb (BMS) that its proposed settlement with Teva Pharmaceuticals USA, Inc., does not raise issues under Section 5 of the Federal Trade Commission Act.

    By a vote of 5-0, the Commission has approved a final consent order and authorized the staff to send letters to the commentors of record in the matter concerning California Pacific Medical Group, Inc, d/b/a Brown & Toland Medical Group The Commission has published transcripts of the three-day joint FTC/DOJ Workshop on Merger Enforcement held in Washington, DC, on February 17-19, 2004.

    The Commission has filed in Federal court its complaint, stipulation, and agreed-to judgment against RHI AG (RHI) to resolve charges that RHI violated various provisions of an FTC order issued in 2001. The Commission has authorized the staff to seek leave to file an amended complaint in the matter currently pending against A. Glenn Braswell, et al. The Commission has authorized the staff to file an amicus curiae brief in Teva Pharmaceuticals USA v. Pfizer, Inc., Case No. 04-1186.

    The Commission has approved a petition from Wright Medical Technology, Inc. (Wright) to reopen and modify a 1994 consent order that arose from Wright’s cash tender offer for all shares of common stock and outstanding convertible preferred stock of Orthomet, Inc.; Tthe Commission has approved a final consent order and letter to the commenter of record in the matter concerning Memorial Hermann Health Network Providers.; The Commission has approved the publication of a Federal Register notice concerning the FTC’s regulatory review schedule.

    Announced Actions for January 9, 2004
    Staff of the Commission’s Bureau of Competition has issued an advisory opinion at the request of Dunlap Memorial Hospital (Dunlap) in Orrville, Ohio, addressing whether Dunlap’s provision of pharmaceuticals to the Viola Startzman Free Clinic (Free Clinic) would fall within the scope of the Non-Profit Institutions Act (NPIA). Following a public comment period, the Commission has approved a modified final consent order in the matter concerning DSM N.V./Roche Holding AG and Koninklijke DSM N.V., et al.
